The current Federal Law No. 115 dated July 25, 2002 (latest amendment) introduced the concept of hiring a foreign worker as highly qualified specialist (HQS).
This can be any foreign worker with experience, skills or achievements in a particular field, provided the employment conditions in the Russian Federation assume that he/she will receive a salary (remuneration) of at least one hundred sixty-seven thousand (167,000) rubles per month.
Obtaining work permit for HQS
HQS can be a foreign citizen of a neighboring country and beyond. The main thing to consider is signing an employment contract under specific conditions. That is, the duration of a contract between an employer and foreign specialist may be indefinite, but a work permit shall not be issued for longer than three years. The specified period of validity may be extended multiple times for the duration of employment contract or ‘independent contractor’ contract to perform work or service, but cannot exceed three years for each extension. Citizens from countries that require a visa have to apply for work visa.
Extending work permit for HQS
Renewal is possible only if an employer complies with legal requirements for this category of foreign citizens. The key requirement is the salary of not lower than the established amount of 500,001 rubles per quarter. It is also necessary to submit a notification on the salary payment (section 8) to the local migration office on time.
– а foreign employee and his/her family members have to be provided with voluntary medical insurance. This has to be written into the employment agreement
– an employer is not required to receive any quotas and permission to attract HQS
– the actual employment vacancy to be filled by employee may not correspond to the Russian job classification table
– HQS work permit registration can apply to several locations in the Russian Federation
– HQS is not required to undergo migration registration within 90 days from the time of entry to Russia
According to the law, it should not exceed more than 14 working days from the date of filing the application and submitting paperwork by an employer with the Ministry of Internal Affairs.
