Foreigners from countries that have a visa regime with Russia must be in possession of an “ordinary working visa” when entering the country. Such visa can be requested only if a foreign worker has a work permit, while an employer requires a permission to hire foreign labor.
The key factor in the employment agreement is the position to be filled by employee.
Jobs are divided into two types:
– Non-quota jobs (refer to the Order of Russia’s Ministry of Labor for the approved list of professions for foreign citizens with no quotas)
– Quota jobs (refer to a complete list in the Russian jobs classification table)
If hiring procedure takes place for the position sourced from the Russian job classification table, then the company should apply for quota before the process is commenced. It could take anywhere between 1 and 8 months to obtain the quota. After receiving the quota or when the job for a foreign employee is selected from the list (not subject to quotas) the company can proceed with the hiring process and obtaining a work permit for a foreign citizen. From the time of contacting the employment center, it takes 90 days on average to complete the procedure.
It should be noted that to obtain a work permit a foreign worker must undergo a medical examination and pass the exam on Russian language, Russian history and the fundamentals of Russian legislation. The company in its turn has to provide an invitation letter.
The working visa invitation is issued after submitting documents for work permit. The process can take up to 20 days. After the invitation is received, a foreigner gets a 3-month single entry visa, and upon entering Russia, may change it into a multiple entry visa at the Ministry of Internal Affairs with the assistance of employer on the basis of a signed employment contract. The employer must also submit the employment contract notice to the police.
