A foreigner work patent is a document confirming the right of a foreign citizen from a visa-free country to work temporarily in the Russian Federation and their legal presence in Russia.
How does a foreigner get a patent?
Once entering the territory of the Russian Federation and passing through passport control, it is necessary to indicate “work” as the purpose of entry in the migration card (115-FZ article 13.3 clause 2, p.3). Doing so is required to apply for the migration service: this is the only way the foreigner can receive a patent.
Next, you need to contact the Ministry of Internal Affairs in person and do the following:
– submit the application form and required documents
– undergo fingerprinting procedure
– pass medical tests
Registration time is 10 working days. The costs may vary. Please note that additional related costs can reach 10,000-12,000 roubles. A number of regions with special migration centers allow you to go through all the necessary procedures at once. For example, in Moscow this is the Multifunctional Migration Center in Sakharovo, and in the Moscow Region – Greenwood.
The validity period of a work patent
A work patent is issued to foreigners for 1 to 12 months, depending on the period for which a fixed advance payment is made. The total duration of the patent, considering all renewals, cannot extend beyond 12 months. A foreign worker must apply again for the patent no later than 20 days before the expiration of a one-year period. Such renewal is possible only once.
Responsibilities while being employed in the Russian Federation
Within 2 months from the date of issuing a patent, a foreign worker must submit a labor or independent contractor agreement to perform work or service. This should be done in person at the local migration executive body or sent to its address by registered mail with a delivery notification. A patent agreement with a foreigner is usually concluded by an employer who is a legal entity. A conclusion notice of such an employment contract with the employee should be filed without delay. It is also essential to arrange alien’s migration registration.
