Following labor laws and migration laws is required when employing foreign nationals. Needless to say, one has to sign an employment contract with every employee, issue an employment order and make a record (or start a new one) in the personal labor book. The same procedures should also be applied to foreign workers. Additionally, one has to file the notification of an employment contract with a foreigner.
The notification form must be filled in Russian via a typewriter or computer. The use of abbreviated words, abbreviations and corrections is not allowed. The notification must include information on every foreign citizen who arrives in the Russian Federation for employment and who has a work permit, a patent or reasons not to receive such permits, and with whom the employer and (or) the client sign an employment and (or) independent contractor agreement. The Ministry of Internal Affairs of Russia should be notified with regards to ALL CATEGORIES OF FOREIGN CITIZENS, including:
- highly qualified specialists (HQS);
- foreign citizens with a temporary residence permit or residence permit;
- foreign citizens with the refugee status or the right to a temporary asylum;
- foreign citizens who have a work permit or patent;
- Citizens of Belarus, Kazakhstan, Armenia and Kyrgyzstan
The application and procedure for submitting the document are set by the federal executive authority that deals with migration. As of April 1, 2018, it is regulated by the Order of the Ministry of Internal Affairs of Russia dated 10.01.2018 N 11, which entered into force on April 20, 2018.
Terms of notification:
The employer carries an obligation to notify the Migration Department about signing and terminating of the employment contract with the foreign citizen within 3 working days. Despite the strict deadlines and the fact that it is legally allowed to send such notices by mail, we nevertheless recommend to appear at the Migration Department in person to be sure everything is done correctly. Unfortunately, some branches experience long queues and problems with the proper functioning of the database, yet this option is still preferable.
